Divorce

The Divorce Act determines that there is a marriage breakdown if you and your spouse have lived “separate and apart” for one year; your spouse has committed adultery; and/or your spouse has been physically or mentally cruel to you.

Divorce can be contested or uncontested; simple or joint.

Parenting

Parenting Plans can be put in place by agreement between the parties, or by order of the Court through a Parenting Order.

A person other than a spouse, which can be a grandparent or someone else important to the child can apply for a Contact Order.

Child Support

Child support is financial support for the child of the relationship after separation. An estimate of the amount can be obtained by visiting the Federal Child Support Calculator

The Family Responsibility Office (FRO) is in charge of enforcing child support payments . While court Orders are automatically registered with FRO, agreements need to be submitted in court before registration with FRO.

Spousal Support

Spousal support is based on the assumption that a spouse financially better-off should provide financial support to the spouse in need.

The determination of spousal support is not a straightforward calculation. Many factors are considered and there is a wide room for judicial discretion.

Family property is dealt differently based on whether the spouses where married or in a common law relationship.

Family Agreements

Both married spouses and common law spouses can depart from the rules respectively in the Divorce Act and Family Law Act by entering a contract to set their rights to the property and support.
