Draft and Review of Agreements:

Legal Agreements or contracts are written documents containing the parties' roles, responsibilities and other terms upon which the parties are in mutual agreement.

To be binding upon the parties, agreements shall meet some requirements, which we will assure your agreement do. We are competent to draft or review a wide range of agreements, including but not limited to:

• Commercial contracts, such as commercial leases, sale contracts, shareholder agreements, business agreements;

• Residential lease agreements;

• Family agreements, such as prenuptial agreement, cohabitation agreement, separation agreement;

• Property contracts, such as wills, sale and purchase contracts; etc.

Alternative Dispute Resolutions: Negotiation/Conciliation/Mediation

Alternative dispute resolutions are a wide range of approaches that help the parties to settle their disputes outside a litigation process.

Negotiation involve communications between the parties advocating for their own interests, while conciliation and mediation requires the assistance of a neutral third-party. All approaches remain consensual.

These means of resolving disputes have traditionally occurred out of the court; but, some of the court process are now imposing mediation before the parties could proceed to litigation.

Advocacy: Litigation and Arbitration

Litigation or arbitration occur when the parties have failed to reach an amicable consensus. Litigation is mainly a court process, while arbitration is out of court, with a neutral third party chosen by the parties to act as a judge.

The arbitration is less formal and has great advantages in terms of costs, speed, predictability and privacy. However, the arbitration award which is the legally binding decision granted by the arbitrator as a result of the process is not appealable, except in very limited circumstances. On the countrary, the judge's decision in litigation process can be challenged in appeal review.
